Minutes of the regular Board meeting of the Town of Normanna, Minnesota, St. Louis County, held in the Normanna Town Hall, on Monday, November 16th, 2009 at 7:00 p.m.  The meeting was called to order by Chair Daniel Johnson at 7:00 p.m.

Members Present:  Chair-Supervisor Daniel Johnson, Supervisor Geoffrey Brown, Supervisor Dennis Gunsolus, and Clerk-Treasurer Ellen Hanson.

Others in Attendance:  Kurt Johnson, Alan Marshall, Paul Hanson, Jim Abbott, Corey Hulst, Everett Swartz, Bill Prudhomme, Steven Abbott, Mark Anderson, Linda Marshall, Eric Norland, Chel Ethun, Leah Hulst, Brian Bergerson, and Jane Link (guest).

Approval of Agenda:  Motion by Johnson, seconded by Brown, and carried approved the agenda as presented.

Approval of Minutes:  Motion by Johnson, seconded by Brown, and carried approved the October 19th, 2009 board minutes as presented.

Normanna Volunteer Fire Department (NVFD):  A. Marshall reported that there were no calls. 

Normanna Ladies Auxiliary:  L. Marshall stated that the newsletter deadline is December 21st.

Normanna Land Use Committee:  No report.

Building and Grounds Report:  No report.

Road and Bridge Report:  Johnson reported that the grading and blading has been completed for the year.

Clerk’s Report:  Hanson reported that she and K. Johnson had completed and submitted the application for the Election Assistance for Individuals with Disabilities (EAID) Grant.  The state will notify us in early December if we were successful.  The November 3rd election went well.  Everything ran smoothly.

Treasurer’s Report:  Hanson distributed the Cash Control Statement, Net Pay Account Distribution Report, and Claims List for approval to the supervisors.  The claims list is attached and the other reports are in the clerk-treasurer’s book.

 Beginning Balance – 10/01/2009 - $62,420.91

Total Disbursements – October - $17,256.27

Outstanding Checks - $2,717.63

Total per Bank Statement - 10/31/2009 - $53,347.24

November claims 1586 – 1595 totaled $2,509.21 were presented for approval.

November payroll checks 2026 – 2029 totaled $563.33.

Motion by Johnson, seconded by Brown, and carried paid the claims as presented and approved the October cash control statement.

Old Business

Propane:  Jane Link, Superior Fuel Company, gave a presentation on her company’s behalf.  A question and answer period followed.  Motion by Johnson, seconded by Brown, and carried to switch the town hall propane service to Superior Fuel Company and purchase a 500 gallon tank.  Gunsolus will make arrangements for the switch over with Ferrell Gas.  Hanson will email Link about the business account information.

Computer Update:  Hanson reported that the computer has not been ordered yet.  Johnson will take this item off the agenda and Hanson will report back when it is ordered.

Furnace Update:  Brown reported that the furnace has been serviced for the season.

Rental Agreement for Town Hall Property:  Johnson presented a form that will be filled out when a resident wants to use town hall property (specifically tables and chairs).  The form will be kept at the town hall.

New Business

Petitions from the Floor:  None.

Designation of Location for Absentee Voting:  Designation is for absentee voting prior to the Annual Town Election which will  be held on March 9th, 2010 at the Fire Hall.  Motion by Johnson, seconded by Brown, and carried designated the town clerk’s house, 6083 Lakewood Road, as the location and the date and time are March 6th from 9:00 a.m. to 5:00 p.m.

Publication of Town Offices up for Election:  Johnson stated that the deadline to publish the legal notice is December 15th, 2009.

Fire Hall Access for Supervisors:  A. Marshall stated that the past practice has been that when a supervisor needs access to the fire hall that they contact the chief for an escorted access.  If a supervisor or the board needs access without the chief they are to contact the clerk who has a key.  The lengthy discussion focused around Gunsolus’s desire to have access to the hall unescorted. Gunsolus’ contentions are that 1. there is little precedent for a VFD controlling access to township property and that my findings indicated that no other townships in the area with exception of Lakewood have tolerated or will tolerate such a policy; 2. that the VFD is a township owned and therefore supervised entity; 3. that the township is liable for all actions of the volunteers – individual volunteers have no personal liability in their volunteer capacity and 4. that there has not “always” been such a policy in Normanna.  There were no formal motions made.  Brown and Johnson felt the past practice was working well.

Correspondence was reviewed.  Checks were signed.

The next meeting of the Board will be December 21st, 2009 at 7:00 p.m.

A motion by Johnson, seconded by Brown, and carried adjourned the meeting at 8:25 p.m.
